Elmer E. Ellsworth had wanted his fire zouaves to be the first zouave regiment mustered in for the war, but instead the honour went to the 9th New York volunteer infantry, Hawkins’ zouaves, who were mustered into federal service on 23 april 1861.

This regiment, colonel Rush C. Hawkins, was organized in New York city, and there mustered in the service of the United States for two years, may 4, 1861; it was accepted by the state, and received its numerical designation, may 13, 1861.
